PRIVATE GATHER DMCA COPYRIGHT POLICY

Private Gather is a service operated by Privora Labs (“Private Gather,” “we,” “us,” or “our”).
Private Gather respects the copyrights and intellectual-property rights of others and expects members, clubs, hosts, and other users of the Service to do the same.
This policy explains how copyright owners and their authorized representatives may submit notices of claimed copyright infringement under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and how affected users may submit counter-notifications.
1. COPYRIGHT INFRINGEMENT IS PROHIBITED
Users may not upload, post, transmit, display, distribute, reproduce, or otherwise make available through Private Gather material that infringes another person's copyright.
Copyrighted material may include:
- Photographs
- Videos
- Artwork
- Illustrations
- Graphics
- Logos
- Written material
- Music
- Audio recordings
- Software
- Promotional material
- Event material
- Website content
- Other copyright-protected works
Members are responsible for ensuring they own content they upload or possess sufficient authorization or legal rights to use and distribute it.
2. PRIVATE GATHER DMCA DESIGNATED AGENT
Private Gather designates the following agent to receive notifications of claimed copyright infringement:

Copyright notices should be sent to dmca@privategather.com so that they can be directed to the Copyright Compliance Department.
Private Gather may request additional information if a complaint does not contain enough information to identify, locate, evaluate, or process the claimed infringement.
3. REQUIRED CONTENT OF A DMCA TAKEDOWN NOTICE
A notification of claimed copyright infringement should be in writing and contain substantially all of the following information.
A. PHYSICAL OR ELECTRONIC SIGNATURE
The notice must contain the physical or electronic signature of:
- The copyright owner, or
- A person authorized to act on behalf of the copyright owner
B. IDENTIFICATION OF THE COPYRIGHTED WORK
The notice must identify the copyrighted work claimed to have been infringed.
If a single notice concerns multiple copyrighted works located on Private Gather, the complaining party may provide a representative list of those works.
C. IDENTIFICATION OF THE ALLEGEDLY INFRINGING MATERIAL
The notice must identify the material claimed to be infringing and provide information reasonably sufficient for Private Gather to locate it.
Useful identifying information includes:
- Exact Private Gather URL
- Username
- Profile name
- Post
- Comment
- Album
- Gallery
- Message
- Club page
- Event page
- Photograph
- Video
- Screenshot
- Description of the material
- Date the material was observed
- Other information reasonably sufficient to identify and locate it
D. CONTACT INFORMATION
The copyright claimant or authorized representative must provide information reasonably sufficient for Private Gather to contact that person, including:
- Full name
- Mailing address
- Telephone number
- Email address
E. GOOD-FAITH STATEMENT
The notification must contain a statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by:
- The copyright owner
- The copyright owner’s agent
- Applicable law
F. ACCURACY AND AUTHORITY STATEMENT
The notification must contain a statement that:
- The information in the notification is accurate, and
- Under penalty of perjury, the complaining party is the owner of an exclusive right allegedly infringed or is authorized to act on behalf of that owner
4. HOW TO SUBMIT A DMCA NOTICE

Notices submitted electronically should use a subject line that clearly identifies the communication as a copyright infringement notice.
The complaining party should include all information required by Section 3 of this policy in the body of the notice or in an attached document.
5. WHAT HAPPENS AFTER A COPYRIGHT NOTICE IS RECEIVED
When Private Gather receives a sufficiently complete notification of claimed copyright infringement, we may:
- Review the notice
- Confirm that required information has been supplied
- Request additional information
- Locate the identified material
- Remove material
- Disable access to material
- Preserve relevant records
- Notify the affected member
- Provide information regarding the complaint to the affected member
- Record the complaint for repeat-infringer enforcement
- Restrict account capabilities
- Suspend an account where appropriate
- Terminate an account where appropriate
Private Gather may act expeditiously to remove or disable access to material identified in a valid notification.
Removal of content in response to a DMCA notice does not constitute a legal determination by Private Gather that copyright infringement occurred.
Private Gather does not act as a court and does not adjudicate ownership of copyrights.
6. INCOMPLETE OR DEFECTIVE NOTICES
A notice that does not substantially comply with applicable DMCA requirements may not provide Private Gather with sufficient information to act.
Private Gather may contact the sender and request additional information necessary to complete or evaluate a notice.
Private Gather is not responsible for delays caused by:
- Missing information
- Incorrect URLs
- Inability to locate material
- Invalid contact information
- Unclear identification of the copyrighted work
- Unclear identification of the allegedly infringing material
7. COUNTER-NOTIFICATIONS
A member whose material was removed or disabled in response to a DMCA notification may submit a counter-notification when the member believes the material was removed or disabled because of mistake or misidentification.
A counter-notification must be in writing and contain substantially all of the information required by applicable law.
A. SIGNATURE
The counter-notification must contain the member's physical or electronic signature.
B. IDENTIFICATION OF REMOVED MATERIAL
The member must identify:
- The material that was removed or disabled, and
- The location at which the material appeared before it was removed or disabled
C. STATEMENT UNDER PENALTY OF PERJURY
The member must state under penalty of perjury that the member has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
D. MEMBER CONTACT INFORMATION
The counter-notification must provide:
- Full legal name
- Mailing address
- Telephone number
- Email address
E. JURISDICTION
The member must consent to the jurisdiction of the United States Federal District Court for the judicial district in which the member's address is located.
If the member's address is outside the United States, the member must consent to the jurisdiction of the Federal District Court for the judicial district in which the service provider may be found, as provided by applicable DMCA law.
F. ACCEPTANCE OF SERVICE
The counter-notification must state that the member will accept service of process from:
- The person who submitted the original copyright infringement notification, or
- An agent of that person

Electronic counter-notifications should clearly identify the communication as a DMCA counter-notification.
9. ACTION FOLLOWING A COUNTER-NOTIFICATION
After receiving a valid counter-notification, Private Gather may provide a copy of the counter-notification to the party who submitted the original copyright complaint.
Private Gather may inform the complaining party that the removed or disabled material may be restored in accordance with the statutory DMCA process.
Subject to applicable law, Private Gather may restore the material after the applicable statutory waiting period unless the Copyright Compliance Department receives notice that the complaining party has filed a legal action seeking a court order restraining the member from engaging in the allegedly infringing activity.
Private Gather may decline to restore material that independently violates:
- Private Gather Terms of Service
- Community Rules
- Privacy policies
- Consent requirements
- Safety rules
- Media policies
- Applicable law
The DMCA process does not require Private Gather to host material that violates other Private Gather policies.
10. REPEAT COPYRIGHT INFRINGER POLICY
Private Gather maintains a policy providing for termination, in appropriate circumstances, of users who repeatedly infringe copyrights.
Enforcement may include:
- Removal of content
- Warning
- Upload restrictions
- Feature restrictions
- Temporary suspension
- Permanent account termination
Private Gather may consider:
- Number of infringement complaints
- Nature of complaints
- Credibility of complaints
- Valid counter-notifications
- Court proceedings
- Repeated patterns of conduct
- Other relevant circumstances
Private Gather reserves the right to terminate an account where circumstances warrant termination even if a specific numeric threshold has not been reached.
11. FALSE OR FRAUDULENT COPYRIGHT CLAIMS
Copyright notices and counter-notifications are legal statements.
A person should not knowingly make a material misrepresentation that:
- Material is infringing when it is not, or
- Material was removed or disabled because of mistake or misidentification when that statement is knowingly false
Federal law may impose liability for knowing material misrepresentations made through the DMCA process.
Private Gather may also restrict or terminate use of its reporting systems by individuals who abuse them.
12. COPYRIGHT AND CONSENT ARE DIFFERENT ISSUES
Copyright ownership and permission to distribute intimate content are separate legal and policy issues.
A person appearing in a photograph does not necessarily own the copyright in that photograph.
Likewise, a person who owns the copyright to an intimate photograph does not necessarily have permission under Private Gather rules to distribute intimate content depicting another identifiable person.
Private Gather may therefore remove content for:
- Lack of consent
- Privacy violations
- Nonconsensual intimate imagery
- Safety concerns
- Community Rules violations
- Terms of Service violations
even when copyright infringement has not been established.
Likewise, a determination that a DMCA notice is incomplete does not mean that the material complies with Private Gather’s other policies.
13. NONCONSENSUAL INTIMATE IMAGERY
The DMCA procedure is intended for copyright claims.
If an intimate photograph or video depicting you has been uploaded, shared, or distributed without your consent, contact Private Gather through the dedicated intimate-image takedown channel:
Private Gather prohibits nonconsensual intimate imagery regardless of who owns the copyright.
14. ABUSE AND SAFETY REPORTS
The DMCA process should not be used as a substitute for reporting:
- Child sexual abuse material
- Content involving minors
- Sexual exploitation
- Trafficking
- Threats
- Harassment
- Impersonation
- Stalking
- Fraud
- Privacy violations
- Other safety concerns
Those matters should be reported to:
Content involving suspected child sexual exploitation should be reported immediately.
15. INFORMATION DISCLOSED DURING THE DMCA PROCESS
DMCA notices and counter-notifications may contain personal information.
Information reasonably necessary to administer the copyright process may be provided to:
- The member who uploaded the challenged material
- The copyright claimant
- Authorized representatives
- Attorneys
- Courts
- Government authorities
- Service providers assisting with legal compliance
A counter-notification may be provided to the person who submitted the original copyright complaint.
Individuals submitting notices should not include unrelated confidential or sensitive information.
16. PRESERVATION OF INFORMATION
Private Gather may preserve information associated with a copyright complaint when reasonably necessary for:
- Processing the complaint
- Processing a counter-notification
- Litigation
- Legal compliance
- Fraud prevention
- Repeat-infringer enforcement
- Defense of legal claims
- Enforcement of Private Gather policies
17. NO DETERMINATION OF OWNERSHIP
Private Gather is not a court and does not determine ultimate copyright ownership.
A decision to:
- Remove content
- Disable content
- Restore content
- Decline to restore content
does not constitute a judicial determination of copyright ownership, infringement, fair use, licensing, or another copyright defense.
18. RESERVATION OF RIGHTS
Private Gather reserves the right to:
- Remove content voluntarily
- Disable access to content
- Request additional information
- Reject materially defective notices
- Address fraudulent complaints
- Suspend accounts during investigation
- Terminate repeat infringers
- Remove material under policies independent of copyright law
- Preserve information when reasonably necessary
- Cooperate with lawful legal process
Nothing in this policy waives any right, defense, limitation, immunity, or safe harbor available to Privora Labs or Private Gather under applicable law.
19. CHANGES TO THIS POLICY
Private Gather may modify this DMCA Copyright Policy to reflect:
- Changes in law
- Changes in Copyright Office requirements
- Changes to Private Gather
- Changes in enforcement procedures
The Last Updated date at the beginning of this policy identifies the current version.
